Lottery Commissions Regulations
made under Section 127 and subsection 128(7) of the
Gaming Control Act

1 These regulations may be cited as the “Lottery Commissions Regulations”.
2 In these regulations
(a) “Commission” means the Nova Scotia Lottery Commission, a body incorporated under the Lottery Act;
[Note: Subsection 128(6) of the Gaming Control Act states that any reference to the Lottery Commission should be read as a reference to the Corporation or the Commission, as the case may be.]
[Note: Effective July 15, 1997, the Nova Scotia Gaming Control Commission and the Liquor License Board are amalgamated as the Alcohol and Gaming Authority by O.I.C. 97-470 under the Gaming Control Act, S.N.S. 1984-95, c. 4, the Liquor Control Act, R.S.N.S. 1989, c. 260, the Theatres and Amusements Act, R.S.N.S. 1989, c. 466 and the Interpretation Act, R.S.N.S. 1989, c. 235.]
(b) “seller” means a volunteer community group which is a member of an agent.
3 The organizations known as Sport Nova Scotia, Cultural Federations Nova Scotia and the Exhibition Association of Nova Scotia are agents for the purpose of these regulations.
4 (1) In this Section, “A-plus Lottery” means the A-plus Lottery operated by the Atlantic Lottery Corporation, a body incorporated under the Canada Business Corporations Act.

(2) The Commission may pay to the seller of an A-plus Lottery ticket a commission in an amount equal to ten percent of the face amount of the ticket sold.

(3) In addition to the commission payable pursuant to subsection (2), the Commission may pay to an agent an amount equal to three percent of the face amount of the ticket sold by the agent’s seller provided that the Commission is satisfied that the agent will use the payment for the purpose only of paying costs incurred in connection with the agent’s administrative services.
5 (1) In this Section, “Provincial Lottery” means the Provincial Lottery operated by Interprovincial Lottery Corporation, a body incorporated by the Canada Business Corporations Act.
(2) The Commission may pay to the seller of a Provincial Lottery ticket a commission in an amount equal to five percent of the face amount of the ticket sold.

(3) Payments pursuant to this Section may be made in respect of tickets sold on or after the first day of January, 1979.
6 Payments pursuant to these regulations may be made at such intervals as the Commission from time to time determines.
7 Payments pursuant to these regulations shall not be made unless the Commission receives profits from the proceeds of a lottery in respect of which the seller sells a ticket.
8 The Lottery Commissions Regulations which were made by the Governor in Council on the 2nd day of November, 1976 pursuant to Order in Council 76-1250 are repealed.
